• If we transfer personal information to a third party acting as an agent on our behalf, Xytech Systems, LLC shall remain liable under the DPF Principles if our
  agent processes such personal information in a manner inconsistent with the DPF Principles, unless the organization proves that it is not responsible for the event giving rise to the damage

4. Our Security Measures to Protect your Personal Information

Our Company uses industry-standard technologies when transferring and receiving data exchanged between our Company and other companies to help ensure its security. Our website has security measures in place to help protect information under our control from the risk of accidental or unlawful destruction or accidental loss, alteration or unauthorized disclosure or access. However, “perfect security” does not exist on the Internet. Also, if our website contains links to other sites not affiliated with us or under our control, our Company is not responsible for the security practices or the content of such sites.

• Our Company websites may use third parties to present or serve the advertisements that you may see at its web pages and to conduct research about the advertisements and web usage. This Privacy Statement does not cover any use of information that such third parties may have collected from you or the methods used by the third parties to collect that information.

Our website includes social media features, including Facebook “Like” button and Twitter “Follow” button. These features may collect your IP address and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the company providing it.

7. Opt-Out

You may opt-out of your personal information: i) being disclosed to third parties that are not contracted by Company that is acting as an agent to prefer tasks on behalf of and under the instructions of Company; ii) used for a purpose that is materially different from the purpose for which the data was originally collected or subsequently authorized by individuals. We will retain any personal information only for as long as is necessary to fulfill the business purpose it was collected. We will also retain and use your personal information for as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

11. Third-Party Onward Transfer

At this time Xytech Systems, LLC does not utilize any third parties as agents or controllers of personal data. Should this policy change in the future, updates will be posted in this document. Should Company in the future engage a third party to act as a controller, Company will: i) comply with the DPF Notice and Choice Principles; ii) enter into a contract with third-party controller that provides that such data will only be
processed for a limited and specific purpose consistent with the consent provided by the individual, and ensure the third party controller provides the same level of protection as Company.

12. Children’s Privacy

Because of the nature of our business, our services are not designed to appeal to minors. We do not knowingly attempt to solicit or receive any information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us immediately.

13. Your California Privacy Rights

Our Company does not currently respond to browser “Do Not Track” (DNT) signals or other mechanisms. Third parties may collect personal information about your online activities over time and across sites when you visit the Site or use the Service.

The Federal Trade Commission has jurisdiction over Xytech Systems, LLC compliance
with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the
EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

17. Disputes and Dispute Resolution

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Xytech Systems, LLC commits to resolve DPF Principles-related complaints about our collection and use of your personal information. EU and UK and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF should first contact Xytech Systems, LLC at [email protected].

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Xytech Systems, LLC commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) and the UK Information Commissioner’s Office (ICO) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF.

Disputes of certain “residual” claims may be resolved via Arbitration as outlined in Annex I of the DPF for any claimed violations of the Principles of the DPF not resolved by any of the other EU-U.S. DPF mechanisms.
